Welcome to ABA Fieldwork Tracker (ABA FT). We built ABA FT to make tracking your fieldwork hours and supervision a whole lot less stressful. These terms explain how ABA FT works, what you can expect from us, and what we expect from you.
By creating an account or using ABA FT, you agree to these terms. If you do not agree, please do not use ABA FT.
1. Who we are, and who can use ABA FT
These terms are an agreement between you and ABA Fieldwork Tracker ("ABA FT," "we," "us," or "our"), including its owner and operator.
You must be at least 18 years old to create an account or use ABA FT. By using ABA FT, you represent that you are 18 or older and that all information you provide to us is accurate.
2. What ABA FT is (and what it is not)
ABA FT is a tool that helps you record and organize your fieldwork hours, supervision, and progress toward your BACB requirements. It does the math and shows you where you stand.
ABA FT is not a substitute for the BACB, your supervisor, or your own judgment. ABA FT does not provide professional, certification, legal, or compliance advice of any kind. We work hard to reflect BACB requirements accurately, but all rule logic, calculations, warnings, and progress indicators in ABA FT are provided for convenience only. The BACB is the final authority on your certification, and requirements can change at any time. You are solely responsible for confirming your own requirements, for everything you submit to the BACB, and for the accuracy of everything you enter in ABA FT. Passing every check in ABA FT does not guarantee that the BACB will accept your hours.
3. Your account
You are responsible for your account and everything that happens under it. Keep your login credentials to yourself, and let us know right away if you believe your account has been accessed without your permission.
4. Your data
Your fieldwork records belong to you. So that we can run ABA FT, you grant us a worldwide, non-exclusive, royalty-free license to host, store, copy, process, transmit, display, and back up the data you enter, as needed to provide, maintain, secure, and improve the service.
You are responsible for the accuracy and lawfulness of everything you enter. Do not enter client-identifying information or protected health information (PHI) in ABA FT. ABA FT is for tracking your professional hours, not client records, and it is not designed or offered as a HIPAA-compliant system. You represent and warrant that you will not enter PHI or any information you do not have the right to store in ABA FT.
You can export your data while your account is active, and we strongly encourage you to keep your own copies. We take reasonable care to protect your data, but we do not guarantee that ABA FT will always be available, error free, or that data will never be lost. Keeping your own backups is your responsibility and your best protection.
In operating, maintaining, developing, supporting, and improving ABA FT, we may use third-party service providers, including artificial intelligence tools and services (such as AI coding and analysis assistants), and your data may be processed by those tools and services for these purposes. We may also offer features of ABA FT that use AI to process your data in order to provide you with output. We select providers that we reasonably believe apply appropriate safeguards, and we use commercial AI services whose terms restrict them from using submitted data to train their models. We may change the tools and providers we use at any time in our discretion.
5. Feedback, reviews, and aggregated data
If you send us feedback, suggestions, feature ideas, or bug reports, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use them for any purpose, without compensation or attribution, and without any obligation to you.
If you post a public review or testimonial about ABA FT, we may quote or reference it in our marketing as written. We will not use your name, photo, or likeness in a paid endorsement or featured testimonial without your separate consent.
We may create and use aggregated, de-identified data about how ABA FT is used (for example, total hours logged across all users) for any purpose, including marketing, research, and product development. Aggregated data will never identify you personally.
6. Staying in touch
By using ABA FT, you agree that we may contact you by email about your account and about ABA FT itself, including updates, tips, new features, and occasional news. You can unsubscribe from non-essential emails at any time, but we may still send you messages required to operate your account or these terms.
We do not sell your personal information.
7. Our intellectual property
ABA FT, including its software, design, branding, content, and rule logic, belongs to us and is protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use ABA FT for its intended purpose: tracking your own fieldwork. You may not copy, modify, resell, reverse engineer, scrape, or create derivative works from ABA FT, and you may not use our branding without permission.
8. Changes to ABA FT and pricing
ABA FT is currently free to use. We are always improving it, and we reserve the right, at any time and in our sole discretion, to add, change, suspend, remove, or discontinue any feature or the entire service, and to introduce, change, or remove pricing for any feature or the service as a whole. If we introduce pricing that affects you, we will give you notice and the chance to accept before you are charged. We are not liable to you or anyone else for any modification, suspension, or discontinuation of ABA FT.
9. Using ABA FT responsibly
Use ABA FT only for its intended purpose and only in compliance with these terms and applicable law. Do not attempt to disrupt, overload, attack, probe, or misuse the service, access anyone else's account or data, use automated tools to scrape or harvest data, create accounts with false information, or use ABA FT to violate anyone else's rights.
10. Termination
We may suspend or terminate your account or your access to ABA FT at any time, for any reason or no reason, with or without notice. You may stop using ABA FT and close your account at any time. Upon termination, your license to use ABA FT ends immediately, and we have no obligation to retain, provide, or transfer your data. Sections of these terms that by their nature should survive termination (including Sections 5, 7, and 11 through 16) will survive.
11. Disclaimer of warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, ABA FT IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, RELIABILITY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT ABA FT WILL BE UNINTERRUPTED, SECURE, ERROR FREE, OR FREE OF DATA LOSS, OR THAT ANY CALCULATION, RULE, WARNING, OR PROGRESS INDICATOR IN ABA FT IS ACCURATE, COMPLETE, OR CURRENT, OR THAT THE BACB OR ANY OTHER BODY WILL ACCEPT HOURS TRACKED IN ABA FT. YOU USE ABA FT AT YOUR OWN RISK.
12. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, ABA FT AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, LOSS OF CERTIFICATION OR CERTIFICATION OPPORTUNITY, LOST INCOME, LOST PROFITS, OR LOSS OF GOODWILL, ARISING OUT OF OR RELATED TO ABA FT OR THESE TERMS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO ABA FT OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR ABA FT IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) FIFTY US DOLLARS ($50).
SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU. IN THOSE JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.
13. Indemnification
You agree to indemnify, defend, and hold harmless ABA FT and its owner, operator, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use or misuse of ABA FT; (b) the data or content you enter, including any client-identifying information or PHI entered in violation of these terms; (c) your violation of these terms; or (d) your violation of any law or the rights of any third party.
14. Governing law, disputes, and arbitration
These terms are governed by the laws of the State of Illinois, without regard to its conflict of laws rules.
Any dispute arising out of or relating to ABA FT or these terms will be resolved by binding arbitration on an individual basis, administered by the American Arbitration Association under its Consumer Arbitration Rules, in Cook County, Illinois or remotely by videoconference. Either party may instead bring an individual claim in small claims court in Cook County, Illinois, if it qualifies.
YOU AND WE EACH WAIVE ANY RIGHT TO A JURY TRIAL AND ANY RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR OTHER REPRESENTATIVE PROCEEDING. DISPUTES MAY ONLY BE BROUGHT ON AN INDIVIDUAL BASIS.
Any claim arising out of or related to ABA FT or these terms must be filed within one year after the claim arose, or it is permanently barred, to the fullest extent permitted by law. For any matter not subject to arbitration, you consent to the exclusive jurisdiction and venue of the state and federal courts located in Cook County, Illinois.
15. Changes to these terms
We may update these terms from time to time. If we do, we will update the version and effective date below. For material changes, we will notify you by email or by a notice in ABA FT before the change takes effect, and if we ever introduce pricing that affects your account, we will ask you to affirmatively accept the updated terms. Your continued use of ABA FT after a change takes effect means you accept the updated terms. If you do not agree to a change, stop using ABA FT and close your account.
16. General
These terms are the entire agreement between you and us about ABA FT and replace any prior agreements. If any part of these terms is found unenforceable, the rest remains in full effect, and the unenforceable part will be modified to the minimum extent needed to make it enforceable. Our failure to enforce any part of these terms is not a waiver. We may assign these terms, in whole or in part, at any time, including in connection with a merger, acquisition, or sale of ABA FT; you may not assign these terms without our written consent. We are not liable for any delay or failure caused by events beyond our reasonable control, including outages, natural disasters, or acts of third parties.
